General Terms and Conditions (GTC)

§ 1 Provider, Scope of Application

These General Terms and Conditions (GTC) apply to all contracts concluded between

(hereinafter referred to as the “Provider”)

and the customers of this website under the domain www.sgrasshoffart.com.

Any deviating terms and conditions of the customer shall only apply if the Provider expressly agrees to them in writing. These GTC apply in the version valid at the time the contract is concluded and also for future transactions unless otherwise agreed.

§ 2 Offers and Conclusion of Contract

The artworks, prints, digital files, or commissioned services presented on the website do not constitute legally binding offers but rather an invitation for the customer to submit an offer.

A contract is concluded when the Provider accepts the customer’s order by order confirmation via e-mail or by shipping the goods or providing the digital file.

Individual commissioned works are created exclusively after personal consultation. In such cases, the contract is concluded through the Provider’s explicit confirmation.

§ 3 Prices and Payment Terms

All prices are stated in Euro (EUR).

The Provider is a small business owner according to § 19 German VAT Act (UStG); therefore, no VAT is shown.

Shipping costs are charged additionally and must be borne by the buyer unless otherwise expressly stated.

Payments can be made via:

PayPal
Advance payment (bank transfer)

The purchase price must be paid within 7 days after conclusion of the contract. Shipping or provision of the digital file will take place after receipt of payment.

§ 4 Delivery, Shipping and Provision

Shipping is carried out from Dortmund, Germany.

Shipping is available worldwide to the delivery address provided by the customer.

Shipping is carried out at the customer’s expense. Costs and options are communicated before conclusion of the contract.

Delivery times are generally:

Germany: approx. 3–7 business days
EU / international: approx. 7–21 business days

Digital content (e.g., digital artworks) will be provided to the customer via download link or e-mail after receipt of payment.

All artworks are carefully packaged (e.g., sturdy cardboard packaging, protective foil, or tube packaging for prints) to avoid transport damage.

For deliveries outside the EU, additional fees or customs duties may apply and must be borne by the buyer.

§ 5 Right of Withdrawal

(1) Withdrawal Policy for Consumers

Consumers generally have the right to withdraw from this contract within 14 days without stating any reason.

The withdrawal period is 14 days from the day on which the customer or a third party designated by the customer takes possession of the goods.

To exercise the right of withdrawal, the customer must inform the Provider at the following address:

by means of a clear declaration (e.g., by e-mail) about the decision to withdraw from the contract.

(2) Consequences of Withdrawal

In the event of an effective withdrawal, the Provider shall reimburse all payments received from the customer, including delivery costs (except for additional costs resulting from a different type of delivery chosen by the customer), without undue delay and no later than 14 days from receipt of the withdrawal notice.

The Provider may refuse repayment until the goods have been returned or until the customer has provided proof of return shipment.

(3) Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

individually created or personalized artworks / commissioned works (§ 312g para. 2 no. 1 BGB),
digital content provided before expiry of the withdrawal period after the customer has expressly consented and the download has already begun.

Refunds

Refunds are made within 14 days after successful withdrawal or return shipment.

Repayment is made using the same payment method used by the customer for the original transaction.

Shipping costs are only refunded if the return is due to an error by the Provider (e.g., incorrect or damaged item).

For personalized or individually created artworks, refunds are excluded unless there is a defect.

In the event of damaged or lost shipments during transport, the customer should immediately contact the Provider and the shipping service provider in order to initiate clarification.

§ 6 Usage Rights and Copyright

All works, files, prints, and digital content created by the Provider are subject to the copyright of Simon Thomas Graßhoff (SGrasshoffArt).

By purchasing a work, the customer does not acquire ownership of the copyright but only ownership of the physical item or a simple, non-transferable right of use for private purposes.

Commercial use, reproduction, distribution, or publication without prior written consent is prohibited.

In the case of permitted publication (e.g., on social media), the author must always be credited as:

§ 7 Liability and Warranty

The statutory warranty rights apply.

The Provider shall only be liable for intent and gross negligence. In cases of slight negligence, liability shall only exist for breaches of essential contractual obligations and shall be limited to foreseeable damages.

The limitation of liability does not apply in cases of injury to life, body, or health or in cases of fraudulent intent.

§ 8 Final Provisions

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The contract language is German.

Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

Place of performance and jurisdiction, insofar as legally permissible, is Dortmund, Germany.

The protection of personal data is important to the Provider. Processing is carried out in accordance with the provisions of the GDPR and the German Federal Data Protection Act (BDSG).

2. Collection and Processing of Personal Data

Personal data is only collected if necessary for contract execution (e.g., name, address, e-mail, payment details).

The data is used exclusively for contract processing and communication.

3. Data Sharing

Data is only shared with third parties:

for payment processing with PayPal or banking institutions,
for delivery with shipping service providers (e.g., DHL),
where there is a legal obligation.

No data is shared with third parties for advertising purposes.

4. Rights of Data Subjects

Customers have the right to:

access stored data,
rectification or deletion,
restriction of processing,
objection to processing,
data portability.

5. Storage, Deletion, Security

Data is deleted as soon as the purpose of processing no longer applies and no statutory retention obligations exist.

Technical and organizational security measures ensure protection of data against loss or misuse.

6. Cookies and Analytics

If the website uses cookies or tools such as Google Analytics, this must be regulated with separate consent (cookie banner).
